DMCA: Digital Millennium Copyright Act Notice and Policy for Everyday States

Everyday States under NextVision Media UG (“NVM”) respects others’ intellectual property rights and requires our users to do the same. AAT will respond to allegations of copyright violations in accordance with the Digital Millennium Copyright Act (“DMCA”). Upon receiving a valid DMCA notification, NVM will promptly take down the offending content. The party whose content is removed will be notified and allowed to submit a counter-notification. If a valid counter-notification is received, the content will generally be restored unless a legal action is filed.

1. To File a Notification of Infringing Content

  • d. A statement that the complainant has a good faith belief that the material is unauthorized by the copyright owner or law.
  • e. The following statement: “I have a good faith belief that the use of the copyrighted materials described above is not authorized by the copyright owner or the law.”
  • f. A statement under penalty of perjury that the provided information is accurate and that the complainant is authorized to act on behalf of the copyright owner.
  • g. The complainant’s physical or electronic signature.

Please note: Misrepresentations in a DMCA notice may result in legal liability for damages. Legal advice is recommended if there is uncertainty.

2. To File a Counter-Notification

If your content has been removed due to a DMCA notice, you may file a counter-notification by providing the following information:

  • a. Identification of the material removed and its previous location.
  • b. Contact details, including name, address, and email.
  • c. A statement consenting to the jurisdiction of the U.S. Federal District Court for your area or Boulder, Colorado if outside the U.S.
  • d. A statement that you accept service of process from the party who submitted the infringement notice.
  • e. A sworn statement that the material was removed due to mistake or misidentification.
  • f. Your physical or electronic signature.
